Pollution Control Certificate– As per provisions of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 all new intending projects (Developmental & Industrial) are required to obtain “Consent to Establish” (popularly termed as NOC) from West Bengal Pollution Control Board. Depending upon the pollution and hazard potential of industrial activities,

  • Consent to Establish [To be applied before setting up of industry and for expansion/upgradation of the industry]
  • Consent to Operate [To be applied before Commencement of Commercial production]. [Consent to Operate to be renewed periodically, Renewal application to be submitted 120 days prior to the expiry of previous certificate].
The West Bengal Pollution Control Board (WBPCB) classifies industries into following category considering nature of Industry, health impacts and also the concept of Pollution Index which is a function of the emissions, effluents, hazardous wastes generated and the consumption of resources:
  • Red (High Risk): Industries with high pollution potential as per category list
  • Orange (Medium Risk): Industries with moderate pollution as per category list
  • Green (Low Risk): Industries with low pollution potential as per category list
  • White (Lowest Risk): Non-polluting industries. These require only intimation / Acknowledgement (not consent) to WBPCB as per category list
  • Exempted: Specific, very low-impact activities. These require only intimation / Acknowledgement (not consent) of WBPCB as per category list.

FSSAI Food Safety and Standards Authority of India (FSSAI) is an autonomous body established under the Ministry of Health & Family Welfare, Government of India. The FSSAI has been established under the Food Safety and Standards Act, 2006 which is a consolidating statute related to food safety and regulation in India.

FSSAI registration is a mandatory conformity used to assure the safety of food products and it is essentially a food safety certificate issued by the food authority in India. FSSAI certificate is compulsory before starting a food business (State / Central). Food-related businesses need to comply with the Act and ensure their own and the customer’s safety

FSSAI registration in a mandatory compliance for the following sectors:

Manufacturers: Manufacturing/processing Dairy products, Vegetable Oil, Meat Products, Novel Food products and all food processing units including re-packers. Trade/Retail: Conducting food business activities such as storing, wholesaling, retailing, distributing, transporting, food vending agencies, supplying, marketing etc. Food Services: Businesses involved in food activities related to preparation and serving of fresh food and drinks. Central Government Agencies: If conducting food business activities i.e. Food canteen/catering services, storing, wholesaling, retailing, distributing food products at Central Govt. Premises. Head Office: If carrying out food business activities in more than one State with the same company/organisation name.

SWID Certificate – The State Water Investigation Directorate (SWID) is an independent directorate under the Water Resources Investigation & Development Department of the West Bengal government, responsible for monitoring, assessing, and managing the state’s groundwater and surface water resources. It serves as the primary authority for hydrogeological surveys, aquifer mapping, water quality assessment, and implementing the West Bengal Ground Water Resources Act.

If any industry wants to augment water resources, sinking of tube wells for extracting ground water, through implementation of various conservation/artificial recharge schemes then when this certificate is required.

Based on Annual Average Rainfall, Quality and Quantity of Ground Water available, State Government has classified the each Blocks of West Bengal as follows:

  • Safe Blocks
  • Semi-Critical Blocks
  • Critical Blocks
  • Un-Assessed Blocks

FIRE SAFETY: Applying for a fire safety certificate (often known as a Fire No Objection Certificate or Fire NOC) for an industrial plant is a structured process designed to ensure compliance with the National Building Code (NBC) and local fire regulations. The process involves technical documentation (such as Site and Building Plans, Fire Fighting Layouts, Factory details etc), physical inspection, and approval from State Fire and Emergency Services.

The compliance involves following steps:

Fire Safety Recommendation (FSR): A Fire Safety Recommendation is a formal, binding set of instructions or guidelines issued by fire authorities (like W.B.F&E.S) outlining mandatory fire prevention, detection, and extinguishing measures for a building. They ensure safety compliance, covering aspects like escape routes, sprinkler systems, and evacuation drills based on building height and usage.

Fire Safety Certificates (FSC): A Fire Safety Certificate (FSC)—often called a Fire NOC—is a mandatory, official document issued by local fire authorities confirming that a building meets all required fire safety norms and regulations. It certifies that necessary safety measures, including extinguishers, alarms, exits, and detection systems, are installed and functional.

Fire License: A fire license is mandatory for businesses storing, processing, or renting premises, especially if they involve high-risk, hazardous, or flammable materials. The process involves a site inspection by fire officials to ensure safety compliance.
